You cannot be evicted for not accepting a new lease

You can always stay month to month. (Source: Oakland Measure V 2022)

If your landlord wants to increase your rent they must:

  • Give written notice in person or by mail 
    • Things that do not count as notice: posting on the door, website portal, call, text, email
  • Give 30 days notice before proposed rent increase goes into effect (35 if mailing!)
  • A new lease is not a rent increase notification, It's a proposal for new terms of the lease. A rent increase notification is a separate document stating the amount you must pay if you continue month to month.

If your landlord serves you with a notice by mail, the copy they mail to you must either:

  1. Have a note on it saying when and where it was mailed, or
  2. Be sent along with an unsigned copy of the proof of mailing (the form that says who mailed it, when, and from where).

Sneaking in rent increase as a parking fee doesn't make it legal

This year, rent increases are limited to 6.3% (source: AB 1482 - 5% + 1.3%). This is state law, separate from Oakland rent control. Parking spot cost increases count towards this. (source: City of Oakland official spoken to on the phone).
If Madison Park has tried to change your rent without following these laws, email them back, citing these laws.

Sharing tenant protection laws and organizing is a protected activity

It is unlawful for a lessor to increase rent, decrease services, cause a lessee to quit involuntarily, bring an action to recover possession, or threaten to do any of those acts, for the purpose of retaliating against the lessee because the lessee has lawfully organized or participated in a lessees’ association or an organization advocating lessees’ rights or has lawfully and peaceably exercised any rights under the law. (CIV § 1942.5)


You cannot sign away your legal rights in a lease. If there's a disagreement between the terms of the lease and the law, the law wins.

  • You feel like you were misled or coerced into signing a new lease or accepting a rent increase
  • Were given a rent increase this year of more than 6.3%
  • Aren’t able to get Madison Park to recognize parking spot cost as part of rent
  • Aren’t able to get Madison Park to give you legal notice of rent increase
